As we all know and are aware of the major and fragile issue of our society that is rape. It is a sexual assault on females and children’s. It has become so common these days that we get to hear about it daily, happening in different districts, cities, states of our country and worldwide. Rape is the most violent crime of all other crimes which is committed against women. It affects the victim physically and mentally. And the punishment should be dreadful. Because the victim suffer huge loss for the entire life. It mostly happens with women’s especially Young one’s but the children are also not safe these days. The society blames the victims for dress shaming instead of pointing the assailants.The main question is about the punishment given for these crimes. Can death penalty deter child rapes? Yes it can stop or prevent less cases. We can’t take it lightly because it’s not something we can’t ignore or let go. People lives matter, their mental illness matter, they should feel free and secured in their own country, but It can also not affect the crimes as well, it can be both. A strict law assist no purpose, if there is no structure in place to make sure that they are executed on time. Rapists know that rape is wrong, but that does not mean rapes are not  committed. Criminals commit crimes because they think they can escape and that is what needs to change.The POCSO Act was amended in August 2019 to introduce the death penalty for the brutal offence of penetrative sexual assault on children.

Points in approval of the death penalty for child rape:

• Sexual violence on children are rising these days. The death penalty implant fear and distress and can deter crimes.
• Minority rapes are different from the rapes of adults. Children who faced sexual harassment are not efficient of dealing with the trauma. Child victims will have emotional pain and trauma throughout their life. It will impact their ability to do well in their life and relationships. On that account, child rapists do not deserve to live.
• If someone is commits a horrifying crime such as raping an innocent child, he is not reconstructible and will be a threat to other children too. Hence the criminal should be eliminated from our society with the death penalty.

• The punishment for both rape and murder are now the same therefore Rapists may kill their victims after the crime.
• Human rights organizations worldwide term the death penalty as repressive that means harsh, severe, extreme.
• Imprisonment till death too will serve the purpose of saving society from these rapists.Still not proved in anywhere in the world that a death sentence is a better obstruction than life imprisonment.
• For solving cases it’s taking years for giving justice to rape victims. If the punishment is the death penalty, cases may be dragged even longer, because if the accused is falsely sentenced, innocent lives will be lost.
• The certainty rate in rape cases is already low. The death penalty may further lower the certainty rate.
• In 95% of the child rapes, the accused is a known person to the victim. In many cases the offender of the crime happens to be a family member or relative or a closed one.The death penalty may deject them to file the case. At present, hardly any rape cases are reported in the police station. Capital punishment may increase the situation.
• In a civilized society punishments should not be awarded to take revenge. Rather they should be able to deter or prevent crimes, reform the criminal and protect society from them.

• 1. India
An executive order passed in 2018 approved the death penalty for rapists of girls below the age of 12 in India. The decision was taken because of the increase in rape cases.Rapists with previous judgements and offenders of sexual assaults that lead to the death of the victim, or leave them in a unconsciousness state, according to the country's criminal law, may also be punished.

• 2. Pakistan
In Pakistan, Under the Penal Code, criminals involved in gang rape can be sentenced to either life imprisonment or death.Last month, Prime Minister Imran Khan said he wanted rapists to be chemically  unmanned or publicly executed after the rape of a woman on a highway provoked protests.

• 3. Saudi Arabia
Rape is a criminal offence under Saudi Arabia's Sharia law and involves a range of penalties such as lashing and execution. At least 150 executions took place in Saudi Arabia in 2019, eight of which were for rape. Saudi has stricter law as compared to India.

• 4. Iran
With at least 250 executions last year, After China, Iran conducted the second-highest number of executions in the world last year , according to Amnesty International. Under the country's Islamic Penal Code, twelve of the executions were for rape.

• 5. United Arab Emirates
Under UAE law, pressurized sex with a woman is punishable by death. The law states that coercion is assumed if the victim is less than 14 years of age at the time of the crime.The UAE did not record any executions in 2019, but charged at least 18 death sentences for crimes including rape, murder and armed robbery.

• 6. China
The country's criminal law declares that anyone who rapes a woman or has sexual intercourse with a girl aged below 14 can face death if the victim dies or is seriously injured, if the victim is raped in public or if the assailant has already committed multiple rapes.If the motive of laws is to attain some appearance of justice, we have to keep up in mind that it must fulfil two purposes. First, people should have faith in the law which has been enacted. And Second, the law should generate fear in the hearts of potential criminals and violators.
